GMA Garnet USA contract dispute

Jim McDermott defended GMA in a breach-of-contract/payment dispute, arising out of the construction of a garnet processing and recycling plant in Coos Bay, Oregon.

At the conclusion of the project, the general contractor demanded payment of approximately $2 million over and above the contracted stipulated sum. GMA denied those requests, relying on the language in the contract. Litigation relating to this dispute was filed in both Oregon and Texas. There were significant legal and factual issues relating to choice of law, licensing, contractual interpretation, evaluation of damages, and timeliness of additional payment requests.

The litigation was settled on favorable terms for GMA and both cases were dismissed.
